Collaboration – A Friendlier Way to Divorce?

Even though their relationship has come to an end, many couples still wish to discuss the financial and child related implications of their separation face to face. They may, however, find it a daunting prospect to do so without the assistance of their solicitor.

Collaborative Family Law may provide the answer. The key elements of this approach which set it apart from more traditional dispute resolution options are:

  • Protracted correspondence between solicitors is avoided. Instead all negotiations take place at meetings attended by the couple and their respective Collaborative Family Lawyers
  • The couple sign a contract at the beginning of the process which states that they will not instruct their solicitors to litigate in relation to the issues in dispute. If negotiations fail, new solicitors must be instructed by both parties.
  • It encourages open, honest, dignified and respectful discussions which should lead to creative and mutually acceptable solutions
  • It aims to foster good relations between the couple-especially regarding their children.
  • It allows for the instruction of a single neutral financial professional to assist the couple in re-arranging their finances.
