Actress Demi Moore has hit the headlines amid speculation that she and her husband, Ashton Kutcher, are experiencing difficulties in their marriage http://www.dailymail.co.uk/tvshowbiz/article-2052682/Demi-Moore-Ashton-Kutcher-public-1st-time-divorce-rumours.html .  Photographs have been published which suggest that she has suffered fairly dramatic weight loss.  It has been suggested that she has struggled to eat since rumours emerged about Kutcher's alleged affair with a 22 year old woman.

The adverse emotional and physical effects of discovering that a partner or spouse has been unfaithful are well known.  The legal consequences, however, are often misunderstood. 

In Scotland, adultery by one spouse gives the other grounds to raise a divorce action immediately.  As well as seeking a divorce, the spouse may apply to the Court to make orders for financial provision in their favour.  Whilst, for most clients whose marriage has broken down, it is preferable to resolve matters out of Court, some may wish to force the pace by raising proceedings.
