Advocacy Unit Lawbites

The first in a series of seminars delivered by members of our solicitor advocacy unit, considering recent developments in the law relating to credit hire claims in Scotland, and providing further information about the benefits of using our in house solicitor advocates.

In light of the Court of Session decision on the issues raised by credit hire claims, Shaun Clark v City of Edinburgh Council,  we now have the benefit of an outer house authority on mitigation of loss in such circumstances. The court approved the long line of English authority on impecuniosity and the requirement to hire on spot rate, unless the claimant has insufficient funds to do so.

The seminar will consider the implications of the Clark case and other recent Sheriff Court cases for defender insurers.
