Charles specialises in commercial disputes and professional
negligence. His professional negligence practice includes
architects, engineers and surveyors and he is "highly regarded for
his work for construction professionals" as endorsed by Chambers
Legal Guide 2011. Charles was a member of the working party which
drafted the pre-action protocol for professional negligence cases
in Scotland.
Charles represents clients across a range of commercial
disputes, with particular expertise in shareholder matters. He
successfully acted in the only UK case in which a minority
shareholder client has been given the opportunity by the Court to
purchase the shareholdings of the majority thereby acquiring
control of the company.
Charles enjoys gardening and dislikes providing an unpaid taxi
service for his offspring.
Career
Qualified 1991, joined Simpson & Marwick 1992, assumed
Partner 1997.
Member of The Law Society of Scotland Professional Negligence
Accreditation Committee, and The Law Society of Scotland.
Charles previously lectured on Construction Law at the
University of Strathclyde. He co-authored 'Risk Management - A
Survival Guide for Architects''.
Recent notable work includes:
Langstane Housing v Riverside Construction & Others
(2009). Charles acted on behalf of his architect clients
defending this multimillion pound case which arose from the
collapse of a commercial building in Aberdeen. The claim against
his clients was ultimately abandoned.
Howes v Crombie (2001). Charles acted
on behalf of an engineer who issued a certificate purporting to
verify the construction of a bespoke house. An action against him
by the first purchaser of the property was successfully defended on
the basis that no duty of care had been owed to them by the
engineer.
