Mark has a impressive experience of civil and criminal actions,
and an equally impressive client base. His practice couples
personal injury work - defending employer's/public liability
actions - in the civil courts, with a substantial criminal caseload
of health and safety and road traffic prosecutions and fatal
accident inquiries. His client portfolio includes businesses, local
authorities and insurers, and he has particular knowledge of the
construction, utilities, food processing and oil and gas sectors.
Mark is a leading member of our first class Health and Safety and
Personal Injury teams, both of which achieved top tier status in
Chambers Legal Guide and The Legal 500.
Mark is a keen golfer who enjoys his young family, the Scottish
climate and the Scottish sense of humour. His favoured holiday
destination is Dubai.
Career
Qualified 1992, joined Simpson & Marwick 1994, assumed
Partner 2005.
Solicitor Advocate. A member of the Forum of Insurance
Lawyers (FOIL), the Health & Safety Lawyers Association and The
Law Society of Scotland.
Mark has spoken widely at external and internal conferences in
respect of Health and Safety issues.
Recent notable work includes:
HMA v APH Services (Dec 2010). Mark made
Scottish legal history by recovering the whole expenses of a Fatal
Accident Inquiry from the Crown on the basis the inquiry had been
unnecessary.
PF(Elgin) v Robert White (Jan 2010). Mark
successfully defended his client through insurers at this criminal
trial, the first in Scotland prosecuting the new offence of causing
death by careless driving.
