We value the tools of mediation and negotiation as a means of resolving disputes. We commit significant resource to training and developing these skills in our people, to provide our clients with the best possible service.

Mediation. Navigating in neutral.

We recognise the virtues of mediation - its simplicity, flexibility and informality. It also often proves successful,  terminating disputes at considerable saving in litigation costs. We are therefore pro-active in encouraging clients to try mediation, particularly in commercially sensitive cases that are likely to come to court. Mediation allows parties to explore whether there is a solution they can accept on their own terms, as opposed to terms being imposed upon them.

The role of a mediator is a skilled one - the art of neutrality whilst steering the exchange toward a positive outcome.  We have solicitors within the firm very experienced in acting in this role, and our Douglas Russell sits as chair of The Law Society of Scotland's mediation panel, which accredits solicitors as mediators.

Seeking a shared solution.

Not all disputes are suitable for mediation, nor can all clients be persuaded to try that course. Where mediation is not an option, we offer clients our superior negotiation skills to settle disputes on their behalf. Not only do all of our young lawyers receive formal training in successful negotiation technique, our large litigation practice provides ample opportunity for their skills to be developed and enhanced on a daily basis, with highly experienced partners and advocates coaching and supervising.
