Occupational Disease

This is one of our largest practice areas.

We are the leading defender occupational disease firm in Scotland, boasting the largest team of legal specialists in this field. Our Occupational Disease Unit offers clients expertise and experience across the board, from the well-established conditions of noise induced deafness, hand arm vibration syndrome and asbestos-related disease to workplace stress and recent and evolving conditions. Our Unit also handle the difficult and often emotive claims of physical, mental and sexual abuse.

And one where we deliver outstanding results.

We know that biggest doesn't always mean best. However, our strength in this specialism offers clients our winning combination of ground-breaking court experience and efficient and successful volume case handling. Our Occupational Disease Unit consists of solicitor advocates, accredited specialists, solicitors and paralegals who share knowledge, best practice and court success. We also work pro-actively with clients to develop policies and procedures to manage and reduce incidents and claims.

Court Success

Our court success includes our ground-breaking defence of the first ever litigated stress claim in Scotland, Cross v Highlands & Islands Enterprise 2000. We also successfully defended hundreds of claims for alleged physical and mental abuse suffered at the hands of The Poor Sisters of Nazareth in schools operated by this religious order. This success continues in the recent important appeal decision of Findleton v Quarriers 2010.

Our influence extends beyond the Courtroom.

As market leaders, we are invited by the Scottish Parliament to provide evidence to assist in the drafting of legislation. We have also given evidence before the Justice Committee on disease related matters.
