In our increasingly sophisticated society such
agreements are no longer unusual.
Although the enforceability of Pre-Nuptial
agreements has not been widely tested before the Scottish Courts,
it is recognised that such agreements are likely to be binding if
properly entered into and if both parties have had the opportunity
to obtain independent legal advice.
As cohabiting couples can now make certain
financial claims in the event of their relationships breaking down,
agreements to regulate the position in that event are often
attractive to our clients.
We regularly accept instructions from clients
to enter into such agreements at an early stage with a view to
avoiding potential conflict in the future.
